1.  Introduction

Please read this page carefully. If you do not accept the Terms & Conditions stated here do not use this website & its services. The term "You" & "User" are herein after used to refer to all persons, individuals and/or entities using this website for any reason. By using this website You accept these Terms & Conditions. MKC reserves the right to modify & revise these Terms & Conditions at any time. Each time You use MKC you should review these Terms & Conditions as by using MKC You are bound by them.

Candidate shall herein after be used to name Nannies, babysitters and other childcare professionals.

2.  Description of MKC Service

2.1 MKC is an open medium where community members are able to post their details as nannies, babysitters or other childcarers. These details are subject to limited screening by MKC & will not appear on MKC until approved by MKC.

2.2 These details are available to persons seeking to employ a nanny &/or babysitter or other childcare professional.

2.3 MKC is not an agency.MKC works as a search tool for families seeking childcare to locate and contact childcarers living or willing to work in the areas where the families require childcare.

3.  Use of the MKC website

3.1 The MKC website may only be used for lawful purposes by individuals and employers seeking childcare related information. The babysitting part of the website may only be used by individuals seeking childcare employment, as a nanny or babysitter, and employers seeking private care for their child or children.

3.2 MKC prohibits the use of its website for the following, but not limited to, violations. All persons, individuals and otherwise, using the MKC website agree not to use, or allow any person, party or individual under their control use MKC for the following:

o    (a) False, incorrect or incomplete postings of biographical information or information which is inaccurate or not your own.

o    (b) Searching the MKC nanny and babysitter database for any purpose other than to find private care for your child or children.

3.3

o    (a) It is prohibited to use the MKC website in a way that is, or may be seen to be, defamatory, discriminatory (whether racist, sexist, prejudice or otherwise).

o    (b) It is prohibited to use the MKC website to (A) distribute, display or transmit information or content which of a commercial nature. (B) To distribute, display, transmit, store or destroy the MKC website content if it infringes on the copyright, trademark or other intellectual property rights of others or violate an individual's privacy or personal rights.

o    (c) It is prohibited for a user to access data not intended for such user. A user may not access or log into a server or account which the user has no authorization to access. It is prohibited to test, scan or probe the vulnerability of the MKC networks & systems or breach security.

o    (d) Attempting to interfere with a users ability to access or use the MKC website & services, their host or network by, but not limited to, the following means "spamming"; sending a virus; "flooding"; crashing; "mail bombing."

o    (e) Tampering or interfering with TCP/IP packet headers is forbidden.

o    (f) By violating any of the above and any other securities of the MKC systems or networks you risk civil or criminal liability.

4.  Use of MKC content

MKCpermits the use & download of a copy of the material provided on the website for your personal use only. The material provided on MKV is not for commercial use. All content provided by & on the MKC website & all other websites under MKC's control are protected under United Kingdom copyright & trademark laws. MKC Users are permitted to search for nannies, babysitters and other childcare professionals. Such Users are permitted to view such person's personal details. Each User of MKC is permitted to post personal submissions regarding their desire and ability to find a childcare position. MKC charges solely for access to the personal contact details of nannies, babysitters and other childcare professionals. By registering with MKC You agree to provide accurate, current & complete information.

6.  Screening and vetting

6.1 MKC acts as a passive conduct for the online publication of User submitted information. Screening and vetting of User information is limited. MKC holds no obligation to screen information or communications in advance. MKC holds no responsibility for screening and vetting Nannies and Babysitters submitted information. The final decision to have communications and/or use information on the MKC site is at your own risk.

6.2 If notified by Users of MKC of communications and/or information which does not conform with the MKC Terms & Conditions, MKC may investigate an allegation and determine at its sole discretion whether to remove information or communication. MKC

7.  Conditions of access by persons seeking childcare & childcarers seeking employment to the service

7.1 You the user are granted access to the MKC website upon complete and thorough registration. Persons seeking childcare are granted full access to nanny, babysitter and other childcare professionals personal contact details during the term when MKC grants free membership to those persons registered with MKC and who are actively seeking childcare assistance. (see point 7. of these Terms and Conditions.)

8.  Content provided by users of the site

8.1 By registering with MKC you agree to provide certain personal information herein after to be called "your information". MKC reserves the right to contact users with information and publicity material. MKC reserves the right to offer relevant third party, and otherwise, products & services to you the User. You agree also that MKC may disclose your information, in an anonymous fashion, to third parties. MKC will not disclose your name, telephone number, email address or postal address to any third party without your prior consent. MKC will only disclose such information to a third party when necessary or appropriate or to comply with applicable laws or in legal proceedings where such personal information is required and relevant.

8.2 Persons and Users registering as Nannies and/or Babysitters agree to have their personal information disclosed to persons and/or Users registered on the MKC website as parents or person's aiding parents who are actively seeking childcare.

8.3 You the User are responsible for all communications. You are also solely responsible for the consequences of posting information on the MKC website. By using the MKC website you agree not to: post obscene, offensive, defamatory, vulgar or abusive material; post material which may be seen to be harassing, hateful, sexist, racist, descriminative or prejudice in any way. You agree not to post material which may be seen as annoying, cause anxiety or inconvenience to another person or entity. You agree not to post copyright material without the explicit permission of the copyright owner; advertisements; chain letters. You agree not to impersonate another person; or material which contains viruses of any kind or use or post any other computer programming method that are intended to interfere with, corrupt or damage data or information.

8.4 MKC reserves the right to edit, omit or delete any information submitted by you to the website.

8.5 Information by Users of the website is not guaranteed by MKC nor does the information represent the views of MKC, the companies' directors or employees. MKC does not guarantee the truthfulness, reliability or accuracy of communications posted by Users of the MKC site. Nor does MKC endorse opinions expressed by Users. By registering and/or using the MKC  website you agree that any reliance on any information contained within the MKC website or posted by Users of the MKC website is at your own risk.

9.  Limitation of liability

9.1 MKC shall not be liable under any circumstances for any loss, damage, expense, or compensation suffered or incurred by the User either directly or indirectly arising from or in any way connected with MKC.

9.2 MKC does not guarantee the suitability of any candidate introduced to the User. The final decision to employ a candidate is the sole responsibility of the User. The User shall therefore satisfy themselves as to the suitability of the Candidate and the User shall take up any references provided by the Candidate to it before employing a Candidate. MKC does not accept any liability for any inconvenience, damage or loss arising whether caused directly or indirectly from any act or omission of a Candidate introduced to the User by MK.

9.3 MKC offers no warranty for a nanny, babysitter or other childcare professionals character, honesty, reliability, suitability or capacity. Because of the nature of the Internet user authentication is difficult, therefore MKC does not guarantee or confirm that any user is who they claim to be.

9.4 MKC is not responsible for the User and Candidates contract of employment. These are to be arranged between the User and Candidate. MKC cannot and is not held responsible for user to user communications. By using the MKC website you agree to release MKC, our agents and employees, from claims, damages and demands of any kind arising out of or in any way connected with any dispute you the User may have with any other User of the website.

9.5 MKC will not be liable for death or personal injury resulting from its negligence.

10.             Disclaimer of warranties

10.1 MKC does not guarantee the reliability or accuracy of content provided on the site. Nor does MKC guarantee that the service will be without fault or error. MKC does not guarantee that a Users specific requirements will be meet by the websites service.

11.             General

Jurisdiction
